PHI Terms of Service

Last modified: August 17, 2022

1. Introduction

Welcome to Phi. These Terms of Service (these “Terms”, these “Terms of Service”) govern your use of our web pages located at https://philand.xyz/ operated by PHI LABS INC. (“PHI”).

Our Privacy Policy (available at [address]) also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (the “Agreements”). You acknowledge that you have read and understood Agreements and agree to be bound by them.

If you do not agree with (or cannot comply with) the Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use Service.

Thank you for being responsible.

2. Promotions

Any contests, sweepstakes, incentive programs, marketing campaigns, or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules and our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

3. Fees

You may be subject to certain fees and commissions for utilizing the Services, as notified to you before performing any transaction thereon or otherwise interacting with the smart contracts thereon. You agree to promptly pay all aforementioned fees and commissions. In particular:

The relevant blockchain network typically requires the payment of a transaction fee ("Gas Fee") for every transaction that occurs on the relevant blockchain network. The Gas Fee funds the network of computers that run the decentralized network. This means that you will need to pay a Gas Fee for each transaction that occurs via the Website.

PHI also reserves the right to impose on users additional fees in the future for access through Smart Contracts or the Website.

4. Accessing the Service

The services provided by this site are limited to hosting an interface that provides a visual representation of a user’s on-chain activities on Ethereum to create their own metaverse. Users may generate "Phi Land" NFTs by controlling ENS domains, and "Phi Object" NFTs by engaging in a variety of on-chain activities. Accordingly, users may tie a variety of on-chain data to their personalized individual identity. We make no representations or warranties that the information, products, or services provided through this site, are appropriate for access or use in any jurisdictions. We reserve the right to limit the availability of this site to any person, geographic area, or jurisdiction, at any time and our sole and absolute discretion.

Like much of web3, your blockchain address functions as your identity on PHI. Accordingly, you will need a blockchain address and a third-party wallet to access the Service. Your account on the service (“Account”) will be associated with your blockchain address.
