1. Introduction

Welcome to PHI. These Terms of Service (these “Terms”, these “Terms of Service”) govern your use of our web pages operated by PHI LABS INC. (“PHI”).

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (the “Agreements”). You acknowledge that you have read and understood Agreements and agree to be bound by them.

If you do not agree with (or cannot comply with) the Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use Service.

2. Promotions

Any contests, sweepstakes, incentive programs, marketing campaigns, or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules and our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

3. Fees

You may be subject to certain fees and commissions for utilizing the Services, as notified to you before performing any transaction thereon or otherwise interacting with the smart contracts thereon. You agree to promptly pay all aforementioned fees and commissions. In particular:

• Fees for Creating: There are no fees paid to PHI for creating your NFTs. However, transactions on blockchain networks require a fee (“Gas Fee”) to cover the computational resources expended to execute the transaction. You are responsible for paying the Gas Fees associated with minting an NFT.
• Fees for Purchasing: Users may purchase a variety of “Creds” or other NFTs (as defined herein) for the sole purpose of collection or to decorate their personal board.
• Fees for B2B/Corporate Users: B2B or corporate users may provide a pre-paid fee or budget allocation to subsidise the fees incurred by “User” when purchasing “Creds” or “NFTs”

The relevant blockchain network typically requires the payment of a transaction fee ("Gas Fee") for every transaction that occurs on the relevant blockchain network. The Gas Fee funds the network of computers that run the decentralized network. This means that you will need to pay a Gas Fee for each transaction that occurs via the Website.

PHI also reserves the right to impose on users additional fees in the future for access through Smart Contracts or the Website.

4. Accessing the Service

The services provided by this site are limited to hosting an interface that:

1. Provides a visual representation of a user’s on-chain activities
2. Provides users a feature to purchase “Creds” based on activities they have completed on-chain.
